Agreement to these terms

These Terms of Use govern your access to maliksi.io (the “Site”), which is operated by Maliksi Creative Technologies Inc. (“Maliksi,” “we,” “us,” or “our”). By accessing the Site, you agree to these terms. If you do not agree, do not use the Site.

About the Site

The Site provides general information about Maliksi and our software-development capabilities. Site content is informational and does not create a client, employment, partnership, fiduciary, or other professional relationship. Any project or service engagement is governed by a separate written agreement.

Intellectual property

Unless otherwise stated, the Site and its text, graphics, logos, designs, software, and other content are owned by or licensed to Maliksi and are protected by Philippine intellectual-property laws and applicable international agreements. You may view and print reasonable portions for personal, non-commercial use. No other reproduction, modification, distribution, publication, sale, or exploitation is permitted without our prior written consent.

Acceptable use

You must not use the Site to violate law or another person’s rights; introduce malicious code; interfere with the Site or its infrastructure; bypass security controls; gain unauthorized access; impersonate another person; scrape or harvest data in a manner that harms the Site or its users; or falsely imply that Maliksi endorses you, your organization, or your products.

Submissions and communications

If you send us feedback, ideas, or other non-confidential suggestions about the Site or our services, you grant us permission to use them without restriction or compensation. Do not submit confidential information unless we have agreed in writing to receive it confidentially. Personal data is handled as described in our Privacy Policy.

Third-party services and links

The Site may link to services operated by third parties. We do not control and are not responsible for third-party content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider’s terms and policies.

Availability, corrections, and changes

We may change, suspend, or discontinue any part of the Site at any time. We may correct errors or update information without notice. We do not promise that the Site will always be available, uninterrupted, secure, current, or error-free.

Disclaimer

To the fullest extent permitted by law, the Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, Maliksi and its directors, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from or connected with the Site. Where liability cannot be excluded, it is limited to the minimum extent permitted by law.

Indemnity

To the extent permitted by law, you agree to indemnify Maliksi against claims, losses, and reasonable expenses arising from your unlawful misuse of the Site or your material breach of these terms.

Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Before filing a claim, each party will make a good-faith effort to resolve the dispute informally for at least 30 days after written notice. Subject to applicable law, disputes that cannot be resolved informally will be submitted to the courts of competent jurisdiction in Makati City, Philippines.

Severability and waiver

If a provision of these terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of that provision.

Changes to these terms

We may update these terms from time to time. The date at the top identifies the latest version. Your continued use of the Site after an update means you accept the revised terms.
